Mogadishu 03 July 2018 – Mayor of Mogadishu, who is also the Governor of Banadir Region H.E. Abdirahman Omar Osman (Eng. Yarisow), has today released a directive revoking all agreements that made on issuing public Parks.
After looking into the agreements made on public parks that situated alongside tarmacked roads and junctions of Mogadishu and confirming the invalidity of those agreements, which are not based on legal process since they remain public lands meant to serve the general interest of the Somali people living in Banadir Region.
The Mayor of Mogadishu, who is also the Governor of Banadir Region, has decided to revoke those agreements. Also, while realizing that the rent from the lease of those lands is less in value and lack the worthiness it deserves. The way contracts are being extended were not legal while the issuance processes were not in-line with set regulations that need to be followed while processing the contract issuance; and seeing it as a regulation and necessary to restore the beauty of the City and public assets, the Mayor has decided to take this decision.
The Governor has laid down the following decree:
Firstly
As from the approval of this rule, all the agreements reached while issuing those parklands situated alongside tarmacked roads and junctions of the city are revoked and remain null and void since they remain public lands that meant to become resting points for the public during their holidays and while on leave, keeping in mind that those parks remain integral part of the public opinion and while restoring the beauty of the city.
Secondly
Relevant business individuals are ordered to vacate within 30 days, to relocate their items and equipment from these parklands and premises that are mentioned previously, since a new plan of restoring these lands back into the hands of the Local Government of Mogadishu is on the course. The effect will take its course as from the approval of this rule.
Thirdly
Whoever breaches or fails to comply with this rule, will have a legal action taken against him/her that remains compatible to their actions. If there is a person who feels dissatisfied with this rule, he or she can contact with higher Administration of Banadir Region and Local Government of Mogadishu before the effect takes it course.
